How SIXPAC collects, uses, shares and protects personal information

Overview

This Privacy Policy explains how Six Pac OTG, LLC, doing business as SIXPAC (“SIXPAC,” “we,” “our” or “us”), collects, uses, shares and protects personal information. It applies to the SIXPAC website, the SIXPAC consumer mobile applications, the SIXPAC business portal and business applications, business-branded experiences powered by SIXPAC, and related services (together, the “Services”).

It covers two groups of people: individuals who use SIXPAC to interact with a business (“Consumers”), and the businesses and their staff who use SIXPAC to run their operations (“Business Users”). Where a section applies to only one group, we say so.

Two commitments up front. SIXPAC does not sell personal information and does not share personal information for cross-context behavioral advertising. SIXPAC does not use children’s information for advertising of any kind.

  • You can access, correct, delete and export your information — see Section 9.
  • The Services are operated from and intended for the United States.

1. Our Role: Who Is Responsible for Your Information

1.1 When SIXPAC decides. For your SIXPAC account, the SIXPAC apps, our website, and our own communications with you, SIXPAC determines how information is used and is responsible for it under this Policy.

1.2 When the business decides. Much of the information in the Services is entered or generated by an independent business — your gym, studio, academy, school or shop — that uses SIXPAC to operate. For that information, the business decides how it is used, and SIXPAC acts as its service provider, handling the information only to deliver the Services on the business’s instructions.

1.3 This matters in practice: if you want a business to stop contacting you, correct your membership record, or delete information it holds about you, contact that business directly. We will help where we can, and we will pass along requests we receive, but the business controls its own records.

1.4 Each business is independently owned and operated and has its own privacy practices. This Policy does not govern what a business does with information after it receives it.

2. Information We Collect

Information you provide

  • Account information: name, email address, phone number, password, and profile photo.
  • Business account information: business name, address, ownership and principal contact details, tax identification, and information provided during application for payment acceptance.
  • Booking and membership information: classes, appointments, check-ins, packages, attendance and program enrollment.
  • Communications: messages you exchange with a business or with SIXPAC support, and your support requests.
  • Optional wellness information you choose to enter: date of birth, height, weight, sex, activity and workout entries, and food or nutrition entries.
  • Content you upload, such as photos, notes and reviews.

Information collected automatically

  • Device and technical data: IP address, device identifiers, operating system, browser type, app version and crash logs.
  • Usage data: pages and screens viewed, features used, referring and exit pages, and dates and times of access.
  • Approximate location derived from IP address. We collect precise device location only if you grant permission, and only for features that need it, such as finding nearby businesses or location-based check-in.

Information from a business

  • A business may enter or generate information about you, including your contact details, membership status, payment history with that business, attendance, notes recorded by staff, and program or skill records such as rank, level or progression.

Payment information

2.1 SIXPAC does not store full payment card numbers or bank account credentials. Payment details are collected and processed by third-party payment companies that SIXPAC engages to facilitate payment acceptance. SIXPAC receives limited transaction information — such as amount, date, authorization result, card brand and last four digits — which we use to display receipts and history and to support the business’s records.

3. How We Use Information

We use personal information to:

  • create and administer accounts and authenticate users;
  • operate scheduling, bookings, check-in, memberships, retail, inventory and other features;
  • facilitate payments, receipts, refunds and dispute research;
  • deliver notifications, reminders and other messages you or a business have configured;
  • provide customer and technical support;
  • detect, investigate and prevent fraud, abuse, and security incidents;
  • maintain records required by law, tax authorities and payment network rules;
  • analyze usage, diagnose problems, and improve and develop the Services; and
  • send SIXPAC service and, where permitted, marketing communications, subject to your choices.

3.1 We may create de-identified and aggregated information that does not identify you and use it to operate, secure, benchmark and improve the Services. We will not attempt to re-identify it.

4. How We Share Information

4.1 With the business you use. Information you provide in connection with a business, and information generated by your activity with that business, is available to that business and its authorized staff.

4.2 With service providers. We share information with companies that perform services for us, including hosting and infrastructure, payment processing, email and SMS delivery, customer support tooling, error monitoring and product analytics. They are permitted to use the information only to provide services to SIXPAC and are bound by confidentiality obligations.

4.3 With payment companies. SIXPAC engages third-party companies to facilitate payment acceptance and settlement. Those companies receive the information necessary to process transactions, perform underwriting and identity verification for business accounts, and meet their own legal and payment network obligations. They handle that information under their own privacy policies.

4.4 For legal reasons. We may disclose information when we reasonably believe it is required by law, subpoena, court order or legal process, or where necessary to protect the rights, property or safety of SIXPAC, our users or the public, or to investigate fraud or a violation of our terms. Where permitted, we will try to notify you first.

4.5 Business transfers. If SIXPAC is involved in a merger, acquisition, financing or sale of assets, information may be transferred as part of that transaction or disclosed under confidentiality obligations during diligence. Any acquirer will be required to handle the information consistently with this Policy or to give you notice and choice before materially changing how it is used.

4.6 With your direction. We share information with third parties when you ask us to, such as when you connect a third-party app or authorize a specific disclosure.

4.7 What we do not do. We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not provide personal information to advertisers or data brokers.

5. Children and Minors

Many businesses that use SIXPAC serve children and teenagers — martial arts academies, youth sports clubs, gymnastics gyms and similar programs. We have structured the Services around that reality.

5.1 Under 13. Children under 13 may not create their own SIXPAC account. A parent or legal guardian may create an account and add a child as a profile within it. Where a business enrolls a child, that business is responsible for obtaining verifiable consent from a parent or guardian as part of enrollment, and SIXPAC handles the child’s information as the business’s service provider.

5.2 Ages 13 to 17. With parent or guardian consent, a person aged 13 to 17 may hold a limited account that allows them to view their schedule, book and cancel classes, check in, track their own activity, and message the business. A limited account cannot store a payment method, make a purchase, or authorize a charge.

5.3 Information about minors. We collect only what is needed to deliver the program the child is enrolled in — typically name, date of birth or age, guardian contact details, schedule, attendance and program progression. We do not require a child to provide more information than is reasonably necessary to participate.

5.4 We never use children’s or teenagers’ information for advertising, marketing profiling, or any behavioral targeting, and we never sell it or share it for cross-context behavioral advertising.

5.5 Parental rights. A parent or guardian may review the information we hold about their child, request that it be corrected or deleted, and refuse further collection, by contacting the business or by contacting SIXPAC at privacy@sixpac.com. If we learn we have collected information from a child under 13 without the required consent, we will delete it promptly.

5.6 When a child is disenrolled from a program, the business controls whether its records are retained. SIXPAC deletes minor profile data associated with a closed account in accordance with Section 8, subject to legal and financial record requirements.

6. Communications and Your Choices

6.1 Marketing from SIXPAC. You can opt out of SIXPAC marketing email using the unsubscribe link, and of marketing SMS by replying STOP. You cannot opt out of service messages about your account, transactions, security or legal notices.

6.2 Messages from a business. Reminders, schedule changes and promotions sent by a business are sent by that business. Reply STOP to a text, use the unsubscribe link in an email, adjust your notification settings, or contact the business.

6.3 Push notifications and location. You can turn off push notifications and revoke location permission in your device settings at any time.

6.4 Message and data rates from your carrier may apply.

7. Cookies and Similar Technologies

7.1 Our website and apps use cookies and similar technologies to keep you signed in, remember preferences, measure how the Services are used, and diagnose errors. We use a limited set of analytics providers for this purpose.

7.2 We do not use cookies or similar technologies for cross-context behavioral advertising, and we do not permit advertising networks to collect information through the Services.

7.3 Most browsers let you block or delete cookies. Blocking them may cause parts of the Services to stop working. Because we do not track users across third-party sites for advertising, Global Privacy Control and “Do Not Track” signals do not change how we handle your information; we honor opt-out preference signals where required by law.

8. How Long We Keep Information

8.1 We keep information only as long as needed for the purpose it was collected, or as required by law. Our general schedule:

(a) Transaction, payment, tax and financial records — seven (7) years from the date of the transaction, to meet tax, accounting and payment network requirements.

(b) Business User account and contract records — seven (7) years after the account closes.

(c) Consumer account information and content — retained while the account is active, and deleted within ninety (90) days after you close your account or request deletion, except where a longer period is required.

(d) Minor profile information — deleted within ninety (90) days after the account holding the profile is closed or the profile is removed, subject to paragraphs (a) and (b).

(e) Support communications — three (3) years.

(f) Security, audit and access logs — up to two (2) years.

(g) De-identified and aggregated data — retained indefinitely, as it no longer identifies anyone.

8.2 We may retain information longer where necessary to resolve a dispute, respond to a chargeback, comply with a legal hold, or enforce our agreements.

9. Your Rights and How to Exercise Them

9.1 Depending on where you live, you may have the right to: know what personal information we hold about you and how we use it; obtain a copy in a portable format; correct inaccurate information; delete your information; opt out of the sale or sharing of personal information and of profiling (note that we do not engage in these); and not be discriminated against for exercising your rights.

9.2 Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Florida, Oregon, Montana and other states with comprehensive privacy laws have these rights under those laws. SIXPAC extends them to all users in the United States regardless of state.

9.3 How to make a request. Email privacy@sixpac.com, or write to SIXPAC, Attn: Privacy, 2205 14th Avenue, Vero Beach, FL 32960. Include your name, the email address on your account, and what you are asking for. You may also access and update much of your information directly in the app or portal.

9.4 Verification. We will verify your identity before acting on a request, usually by confirming control of the email address on the account. We may ask for additional information if we cannot verify you with what we have.

9.5 Timing. We will respond within forty-five (45) days, and may extend once by another forty-five (45) days where reasonably necessary, with notice to you.

9.6 Authorized agents. You may use an authorized agent to submit a request. We will require proof of authorization and may require you to verify your identity directly.

9.7 Appeals. If we decline your request, you may appeal by replying to our response or writing to privacy@sixpac.com with “Appeal” in the subject line. We will respond to an appeal within forty-five (45) days and, if we deny it, will tell you how to contact your state attorney general.

9.8 Requests involving a business. If your request concerns information a business holds about you, we will forward it to that business and support them in responding, but the business makes the decision.

10. Security

10.1 We use administrative, technical and physical safeguards designed to protect personal information, including encryption of data in transit, access controls, and monitoring. Payment card data is handled by third-party payment companies in accordance with applicable payment card industry security standards.

10.2 No system is perfectly secure. We cannot guarantee that information will never be accessed, disclosed, altered or destroyed. Keep your password confidential and notify us at support@sixpac.com if you suspect unauthorized access.

10.3 If a breach of your personal information occurs, we will notify you and applicable authorities as required by law.

11. Where Information Is Processed

11.1 The Services are operated from the United States and are intended for use in the United States. Personal information is stored and processed in the United States and is subject to United States federal and state law.

11.2 The Services are not directed to individuals in the European Economic Area, the United Kingdom or Switzerland, and SIXPAC does not offer the Services there. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

12. Third-Party Links and Services

12.1 The Services may link to or integrate with third-party websites and applications. We are not responsible for their privacy practices. Review their policies before providing information to them.

12.2 If you connect a third-party account to SIXPAC, that provider may send us information about you according to your settings with them.

13. Changes to This Policy

13.1 We may update this Policy. We will post the updated version with a new “Last Updated” date and keep a link to the prior version. If the changes are material, we will notify you by email or in the app, and where required by law we will seek your consent.

13.2 Information already collected will continue to be handled under the version of the Policy in effect when it was collected, unless you consent otherwise.
